Permitted, Unpermitted, and Permit-Not-Required Determinations

Permitted Activities

All District permits are reviewed and approved by the Board of Managers prior to issuance. Once issued, a permit is valid for 2 years to complete the project and all stipulations of the permit. Various permit phases are used to help track the permit status which are further outlined in our guidance documents.

Permit-Not-Required Determination

Not all land disturbance activities require a permit or trigger District Rules. Through our Pre-Permit Application process, we will help you make a determination. If a Permit-Not-Required determination is made, we will provide you with a Certificate of District Compliance as documentation should other entities or concerned citizens question your activity.

Unpermitted Activities

Observed or reported unpermitted activities will be confirmed with a site investigation. If suspected or determined to note be incompliance with District Rules the project will be considered a violation and will become classified as an After-the-Fact (ATF) permit and subject to doubling of permit fees to cover the staff time that commonly exceeds the normal permitting process. An ATF fee reduction request is viewed favorably when and applicant:

  1. Immediately complied with Cease-and-Desist Request (CDR)

  2. Promptly (within 72 hours of notification) contacted CMSCWD staff.

  3. Submitted a completed permit application within 7 days of notification.

  4. Provided all required materials within 21 days of application.

If all criteria are met within the outlined timeframe, Staff will present your ATF Permit Fee Reduction Request to the Board of Managers at the next regularly scheduled Board Meeting.

Reporting Unpermitted Activites

If you are a concerned citizen that notices a project may be occurring without a Watershed Permit, please contact staff ASAP. Early notifications have benefits for District Staff, landowners/contractors, and the water resources our Rules are intending to protect. District Staff promptly start an investigation and notification process until any required permit is obtained. As a concerned citizen, your privacy is a priority and is protected. Unpermitted activities can be reported directly to the Riparian Permit Specialist (Tom Langer) and/or District Administrator (Mike Isensee).
